Managing Risk by Working across the 3 Main Acts

Managing risk is at the heart of social work. In Scotland there are 3 main pieces of legislation that work together to manage and respond to risk of harm and support and protect adults with mental disorder. These are the Adults with Incapacity (Scotland) Act 2000, the Mental Health (Care & Treatment) (Scotland) Act 2003 and the Adult Support & Protection (Scotland) Act 2007.

In this training we are going to look at the unique functions and powers of each Act, and examine areas where they overlap and complement each other. However, given that there are three different acts it is understandable that workers can become confused about what legislation is most appropriate for the person they are working with. We will examine some of the challenges in applying legislation to our practice, including the impact of human rights legislation. We will use case studies to help us make sense of how to apply the law to practice.
